The Fair Housing Act of 1988 is the law that opens doors to ESA handlers.
This qualification allows you to live with your animal in “no pet policy” buildings and communities. By law you are exempt from pet fees and deposits along with breed and weight restrictions.
HOUSING: Amendments to the Fair Housing Act of 1988. For your ESA to be accommodated in “No Pet” housing is to provide a copy of the ESA letter to your Property Manager as a request for accommodation to the pet policy, of pet fees, weight or breed restrictions. The ESA letter documents your emotional disability as required by the Fair Housing Act. No further documentation should be required for an ESA by the housing. Further documentation may be required for Service Animals as they do not have an evaluation or a letter such as ESA’s.
Hotels, Restaurants, and Stores: Emotional Support Animals are protected under the Federal law cited above for housing (where postal service delivers mail). Certain locations may allow for ESA’s but it would be on an individual basis and at the discretion of management. Check state and local laws to ascertain if ESA are granted additional rights. For hotels call ahead and ask if they accommodate assistance animals and if they waive pet fees.
Service animals have specific access rights granted to them to facilitate their assistance to individuals with disabilities. Here are some general aspects of the access that service animals typically have:
It's important to note that while service animals have broad access rights, they are expected to behave appropriately in public and adhere to hygiene and cleanliness standards. Additionally, the definition and regulations regarding service animals can vary by country and region, so it's essential to be aware of local laws and regulations. In many places, only dogs and in some cases miniature horses, are recognized as service animals. Other animals, even if providing emotional support, might not have the same legal protections.
We have a strict no refund policy.
